Supreme Court of Texas announces 
Substantial Changes to Rule 103
to take effect February 1, 2005

 

NEWS:  On October 7, 2004, the Texas Supreme Court announced substantial changes to Rule 103 of the Texas Rules of Civil Procedure.  Those changes will affect every private process server in the state, and will affect the way all service will be undertaken in the state of Texas. PS-Academy provided valuable input to help the Court implement those changes.

Over the past year, we met with Judges, Senators and Legislators, and corresponded with the Supreme Court of Texas in an attempt to get changes enacted to Rule 103 of the Texas Rules of Civil Procedure. We sought these changes because we believed there was a need to improve the efficiency and professionalism of the entire industry in Texas, and to ensure that only persons who were properly trained and qualified gained authorization from the courts.

Seeing the same need, the The Supreme Court of Texas enacted numerous changes that are expected to dramatically improve the entire industry by requiring professional training, and by enabling process servers to obtain a single certification from the Supreme Court of Texas in order to provide professional services throughout the state.

 1.  Help me understand the "Certified Process Server" designation.
 2.  How will the proposed changes affect the course I took at PS-Academy?
 3.  How will the proposed changes affect the Standing Order I already have out of courts in Dallas or Denton counties?
 4.  How will the proposed changes affect the Standing Order I already have out of courts in Harris county?
 5.  How will the proposed changes affect my ability to serve papers out of other state and county courts?
 6.  Will Certified Process Servers be able to serve process out of courts in Harris County?
 7.  Will the Supreme Court be the exclusive means for authorizing service of process?
 8.  Will all trial courts be required to allow a Certified Process Server to serve process out of their courts?
